Legal notice and terms of service

In compliance with article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce:

1. What these terms are

These terms govern the cleaning, plumbing, electrical, locksmith, air conditioning and home maintenance services that Listo Marbella provides in Marbella and the surrounding area. By booking a service with us, you accept these terms.

2. How a booking is made

You message us on WhatsApp, call us, or use the website assistant. We confirm the price for the work and a time slot in writing. The contract is formed when you accept that confirmation. Until then you are committed to nothing.

3. Prices

Our price promise

The price we confirm to you in writing before the technician sets off is the price you pay for that work. If our invoice for the agreed work exceeds the price you approved, that work is free.

This promise does not cover: additional work you authorise afterwards, materials and parts quoted separately, or work outside the agreed scope. In those cases we give you a new price and you decide.

4. Response times

On emergencies within the municipality of Marbella, counted from the moment we confirm the booking: locksmith within 30 minutes, plumber or electrician within 60 minutes. If we arrive later than that, we take €20 off that invoice.

This commitment does not apply outside the service area, in cases of force majeure (accidents, road closures, extreme weather or official restrictions), or where on arrival access to the property is not possible for reasons outside our control.

5. Guarantee

The guarantee does not cover pre-existing defects unrelated to our work, materials supplied by you, misuse, tampering by third parties, normal wear, or structural causes in the property.

These commercial guarantees are additional to and in no way limit the rights Spanish consumer law gives you under Royal Legislative Decree 1/2007.

6. Right of withdrawal

If you book remotely (by WhatsApp, phone or the website) and you are a consumer, you have 14 calendar days to withdraw without giving a reason, by writing to [email protected].

However, if you expressly ask us to start before that period ends (which is normal in an emergency), you lose the right of withdrawal once the service has been fully performed, under article 103.a of Royal Legislative Decree 1/2007. By requesting emergency attendance you are expressly asking us to begin immediately. If you withdraw once work has started, we will charge the proportionate value of what has already been done.

7. Payment

You can pay by card on completion, by Bizum, in cash, or via an online payment link if you are not at the property. We issue an invoice with our CIF by WhatsApp and email. Payment is due on completion of the work unless otherwise agreed in writing.

8. Who carries out the work

Work is carried out by our own staff and by qualified independent professionals whose identity, registration and official certification we verify before they enter anyone's home. Electrical work is performed by authorised installers and air conditioning work by RITE and F-gas certified technicians. Before each job you receive the name and photo of the technician who will attend.

9. Access to the property and keys

If you take the Home Care plan and give us keys, we hold them under a custody protocol with an in/out log and a maximum of two authorised people. You can take them back at any time. Without a plan, we coordinate access with whoever you tell us and send you arrival and departure photos.

10. Home Care plan

The Home Care plan costs €29 per month or €290 per year, with no lock-in. You can cancel at any time and it will simply stop renewing at the end of the period already paid, with no penalty.

11. Cancellations

You can cancel or reschedule a booking free of charge with at least 2 hours' notice. If the technician has already travelled and cannot access the property for reasons outside our control, we may charge the call-out amount.

12. Liability

We are liable for damage we cause through our fault while carrying out the work. We are not liable for pre-existing defects in the property, for materials you supply, or for damage arising from installations that were already in poor condition and which we flagged to you in writing. Nothing in these terms excludes or limits our liability where the law does not allow it.

13. Complaints

Write to us first at [email protected]: most things get sorted the same day. We keep official complaint forms (hojas de reclamaciones) available to customers. If you booked online, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

14. Governing law

These terms are governed by Spanish law. If you are a consumer, any dispute may be brought before the courts of your place of residence.
